Regarding the registration of attorneys who make the certification, signature, and documents

By Section 27 (3) and with the approval of the Special President of the Lawyers Council, Section 28 of the Lawyers Act B.E. 2528, the Lawyers Council of Thailand has issued regulations on the registration of lawyers who make the endorsement and signature and The documents are as follows

Article 1 This regulation is called “Regulations on Registration of Lawyers Who Make Certification, Signature and Documents B.E. 2551”

Article 2 This regulation is effective from the day following the date of its publication in the Government Gazette.

Article 3 Application for registration of lawyers, certified signatures, and documents To submit an application in the form prescribed by the Lawyers Council In which the applicant must pay the fee not exceeding the rate specified in the annex of this regulation

Article 4 Application for registration as a lawyer, certified signature, and documents Applicants must have the following qualifications

(1) being a professional lawyer

(2) Pass the training course on the signature and document certification by the regulations and criteria set by the Lawyers Council.

(3) not being punished for the misconduct of a lawyer under Section 52 (2).

(4) not being a person who behaves with detriment or lack of good morality. And not acting in any way that shows distrust in honesty

Article 5 When receiving an application for registration If the applicant has the qualifications according to Article 4, the Lawyers Council of Thailand shall accept the registration and issue a certificate with registration number and stamp to the applicant promptly

If the Lawyer Council does not accept registration for the applicant Must clearly show the reasons for not accepting registration In such case The applicant has the right to appeal the rejection to the special promotion of the Lawyers Council within 30 days from the date of receiving the notification of the rejection order from the Lawyers Council. Order of the Special President of the Lawyers Council to be final

Article 6 The Certificate of Registration shall be valid for 2 years from the date of issue. To renew the registration certificate, submit an application in the form prescribed by the Lawyer Council. In which the applicant must pay the fee not exceeding the rate specified in the annex of this regulation

Subject to Article 4, a lawyer wishing to renew the registration certificate must submit an application within 90 days before the expiration date.

Article 7 In the case of the certificate Or the seal is lost If the loss or damage, in essence, the lawyer shall submit an application for a replacement or a replacement seal in the form prescribed by the Lawyers Council within 30 days from the date of acknowledgment of the loss or damage.

Article 8 Attorneys who have been registered as lawyers who make the endorsement of signatures and documents. If there is a change in the registration information from the original notification Must submit a request to notify a change in the information by the form prescribed by the Lawyers Council within 15 days from the date of the change, provided that the fee shall not exceed the rate stipulated in this regulation.

Article 9 The certificate of registration and seal shall be as prescribed by the Lawyers Council.

Article 10 The Lawyers Council of Thailand shall order a registered attorney to terminate his or her affirmation, signature, and documents in the following cases:

(1) Disqualifications under Article 4

(2) Non-renewal of the certificate

(3) To certify the signature and any false documents or representations.

Article 11 A lawyer who has retired from being a lawyer who makes a certificate, signature, and documents under Article 10 has the right to appeal the order of the Lawyers Council to the Special Occupation of the Lawyers Council within 30 days from the date of receiving the order from the Lawyers Council Order of the Special President of the Lawyers Council to be final

Article The Lawyer Council shall set the fee for registration as a lawyer who makes the certification, signatures, and documents not exceeding the rate specified at the end of this regulation.
